Terms of Service

1. Who we are and what these terms cover

GOTAFIMA Institute of Financial Markets ("GOTAFIMA", "we", "us") operates an online financial-markets ecosystem providing education, research, market information, community features, and introductions to independent third-party brokers. These Terms of Service ("Terms") govern your access to and use of the GOTAFIMA websites, applications and services (together, the "Platform").

By creating an account or using the Platform you agree to these Terms and to the Privacy Policy, Risk Disclosure and Cookie Policy, which form part of this agreement. If you do not agree, do not use the Platform.

2. What GOTAFIMA is — and is not

GOTAFIMA is an education and technology institution. We are not a broker, custodian, bank, investment manager or licensed financial adviser, and nothing on the Platform is investment advice, a personal recommendation, or an offer or solicitation to buy or sell any financial instrument.

Trading services are provided directly by independent third-party brokers under their own terms, licences and regulation. When you open an account with a broker introduced through the Platform, your contractual relationship for trading is with that broker, not with GOTAFIMA.

3. Eligibility and your account

• You must be at least 18 years old and legally capable of entering into this agreement in your jurisdiction.
• You must provide accurate registration information and keep it current.
• Your account is personal. You are responsible for safeguarding your credentials and for all activity under your account; notify us immediately of any suspected unauthorised use.
• An account remains inactive until its email address is verified.
• Some features require additional verification tiers before they can be used.

4. Education first

The Platform is built education-first: every service is explained before it can be used, and premium services describe their requirements, risks and activation steps before any subscription is offered. Educational content teaches process and discipline. It does not promise, imply or guarantee trading profits, and completing any programme does not ensure financial success.

5. Premium services and subscriptions

• Premium services (including the AI BOT, Copy Trading, Signals Marketplace, P2P Marketplace, Professional Indicators and VIP Academy) require an active subscription once they launch. Pricing and subscription terms are published with each service before it opens; you are never charged for a service that has not launched.
• Subscriptions grant access to the described service for the paid period. Unless stated otherwise at purchase, subscriptions do not auto-convert into different services.
• We may modify, suspend or retire a service; if a paid service is retired mid-subscription, we will provide a proportionate remedy as described at purchase or required by law.

6. Broker introductions and affiliate relationships

GOTAFIMA maintains transparent affiliate partnerships with selected brokers and may receive compensation when you open or fund an account through links on the Platform. Partner links are marked with sponsored-link attributes, and our Affiliate Disclosure appears wherever partner brokers are presented.

Affiliate compensation never changes our education-first rule and does not constitute an endorsement of any broker for your particular circumstances. You are responsible for reviewing each broker’s terms, regulation and suitability before opening an account.

7. Acceptable use

• Do not use the Platform for any unlawful purpose, or in breach of applicable sanctions, anti-money-laundering or market-abuse rules.
• Do not attempt to gain unauthorised access to accounts, systems or data, probe or test vulnerabilities without written authorisation, or interfere with the Platform’s operation.
• Do not scrape, harvest or bulk-download content or member data, or misrepresent analytics or attribution signals.
• Do not impersonate GOTAFIMA, its staff or other members, and do not present GOTAFIMA content as personalised financial advice to others.

8. Intellectual property

The Platform and its content — including courses, research, indicators, software, branding and design — are owned by GOTAFIMA or its licensors and protected by intellectual-property law. You receive a personal, non-exclusive, non-transferable licence to use the Platform for its intended purpose. You may not copy, resell, redistribute or create derivative works from Platform content without our written permission.

9. Disclaimers and limitation of liability

The Platform is provided "as is" and "as available". To the fullest extent permitted by law, GOTAFIMA disclaims warranties of merchantability, fitness for a particular purpose and non-infringement, and does not warrant that the Platform will be uninterrupted, error-free or that market information is complete or current.

To the fullest extent permitted by law, GOTAFIMA is not liable for trading losses, loss of profits, loss of data, or indirect, incidental, special or consequential damages arising from use of the Platform or from your relationship with any third-party broker. Nothing in these Terms excludes liability that cannot be excluded by applicable law.

10. Suspension and termination

You may close your account at any time. We may suspend or terminate access, or place the Platform into maintenance, where reasonably necessary — including for breach of these Terms, legal compliance, security, or protection of other members. Where practicable we will give notice and a reason. Sections that by their nature survive termination (including intellectual property, disclaimers and governing law) continue to apply.

11. Changes to these Terms

We may update these Terms as the Platform evolves. Each version carries a version number and effective date. For material changes we will give reasonable advance notice on the Platform or by email; continued use after the effective date constitutes acceptance.

12. Governing law and contact

These Terms are governed by the laws of the United Republic of Tanzania, without prejudice to any mandatory consumer protections of your country of residence. Disputes are subject to the jurisdiction of the competent courts of Tanzania unless applicable law provides otherwise.
